Please read the following terms and conditions carefully before signing in for any of the staking programs.

AGE

You undertake you have attained the age of majority in your respective country and/or the minimum age of 18 years before you can partake in any of the staking programs herein.

MEMBERSHIP

[Top Earners Market] is available and open to interested applicants/members of the general public across the globe however, only qualified members of [Top Earners Market], will be allowed to partake in any of the staking programs.

USE OF TOP EARNERS MARKET WEBSITE

The access and use of this website are restricted only to our members and to individuals personally invited by our members.

You undertake not to use this site in contravention of national and international laws

DEPOSITS

Every deposit Paid by a member is considered a private transaction between the [Top Earners Market] and its Member.

DEPOSIT FORFEITURE

It is Top Earners Market’s rule and policy, that all deposits received from members shall not be refunded before the expiry or lapse of the staking period. The staking periods range from 3 to 12 months.

In the event, that any member applies for a  deposit refund before the expiry or lapse of a staking program, Top Earners Market will refund the deposit less administrative costs and less one month's reward based on the planned stake period/duration.

Members who seek to cancel their staking plans in favor of upgrading their staking plans must stake a higher amount/ value and shall not be allowed to withdraw the canceled staking amounts and if they opt to withdraw, they shall be subjected to the early termination clause in line with the clause above on deposit forfeiture.

GRACE PERIOD BEFORE STAKING

For member funds amounting to USD 100,000 or more, Top Earners Market requires sufficient time to plan and/or strategize which platforms these funds can best be utilized for optimum rewards to Top Earners Market members, and as such these funds can not be immediately credited for staking.

Top Earners Market requires a grace period to enable it to utilize the funds effectively.

With effect from Monday 18th January 2021, Top Earners Market shall impose a mandatory grace period as per the table below before any crediting of funds for staking can be done.

REFERRAL COMMISSION Members who have not staked in any Top Earners Markets’ plans/programs shall not be allowed to withdraw referral commissions they have earned from their own lines (from members they have introduced to the Top Earners market)

WITHDRAWAL OF REWARDS

Withdrawal of rewards shall only be done from Monday to Friday from 10.30 am to 4.30 p.m. 

Withdrawals shall be effected within 24 hours from the time a member applies / requests for such withdrawal.

In the event, that a member requests for withdrawal of rewards on a Friday after 4.30 pm or during the weekend, such withdrawal requests will be processed on Monday while observing the 24-hour rule of processing such a reward.

INSTANCES WHEN WITHDRAWALS SHALL NOT BE ALLOWED

If a member opens a Top Earners Market account but does not stake and proceeds to bring in new members or refers members to Top Earners Market as the member’s downlines, such a member shall not be allowed to withdraw his/her referral commission earned from his/her downlines until such a member stake in any of the Top Earners Market’s staking plan/programs

If a member applies to upgrade his/her staking plan but instead opts to withdraw the canceled staking before maturity, such a member shall be subjected to the early termination clause in line with the deposit forfeiture clause, which is one monthly reward and administrative costs.

EXEMPTIONS

As a private transaction, this program is exempt from the US Securities Act of 1933, the US Securities Exchange Act of 1934 and the US Investment Company Act of 1940, and all other rules, regulations, and amendments thereof. We are not FDIC-insured. We are not a licensed bank or a security firm.

INFORMATION, COMMUNICATION & MATERIALS

You agree that all information, communications, and materials coming from [Top Earners Market]  are unsolicited and must be kept private, confidential, and protected from any disclosure. Moreover, the information, communications, and materials contained herein are not to be regarded as an offer, nor a solicitation for investments in any jurisdiction which deems non-public offers or solicitations unlawful, nor to any person to whom it will be unlawful to make such offer or solicitation.

PERSONAL DATA

All  Personal data given by a member to [Top Earners Market] will only be used privately and not disclosed to any third parties. Whereas [Top Earners Market]  is not responsible or liable for any loss of data, it will endeavor to take good care of such data.

LIABILITY

Whereas it is Top Earners Market’s objective and general policy always to exercise sound judgment, prudence, and due diligence while trading, it is not possible to guarantee exact and past replica performance owing to market trade fluctuations and market volatility.

You undertake not to hold Top Earners Market liable for any loss as you are staking at your own risk and you hereby agree that past performance is not an explicit guarantee for the same future performance. 

You agree that all information, communications, and materials you will find on this site are deemed as informational,  educational, and not taking advice.

CHANGE OF RULES /TERMS

Top Earners Market reserves the right to change the rules, commissions/rewards, and rates of the staking program at any time and at our sole discretion. However, members will be notified of such change within a reasonable time

RIGHT TO CONTROL THE NUMBER OF MEMBERS PER STAKING PROGRAM

Top Earners Market reserves  the right to control the number of members per staking program and to declare a particular program " sold out " 

The company also reserves the right to spread out a member's deposit (Stake)   in all the staking programs at the point the member applies/ requests for a particular staking program.

The member  thereafter  shall take the staking program(s)  available 

This spread out avoids oversubscription or overloading  of a particular staking program

TECHNICAL PROBLEMS

Technical problems do occur while using the website so it is therefore prudent to contact the administrator.

SPAM

We shall not tolerate SPAM or any type of UCE in this program. SPAM violators will be immediately and permanently removed from the program.

FORCE MAJUERE / VIS MAJOR

Force Majeure is caused by extraordinary events or circumstances that are beyond the reasonable control of a party and this includes but is not limited to war, strikes, riots, epidemics, pandemics, trading market crashes, etc.

Vis Major or Superior force or Act of God is an irresistible natural occurrence that causes damage or disruption that is neither caused by nor preventable by human beings even when exercising utmost skill care, prudence or diligence. This includes but is not limited to Earthquakes, Floods, hurricanes, Tornados, calamities, etc 

In the event force Majeure or Vis major does  occur, Top Earners, Market shall invoke/ exercise either of the 3 options below

Trading can be suspended and the member’s money (deposits and rewards)  held for a period X waiting for the situation to normalize and  thereafter trading continues from the last point of trading 

Return the capital/deposit to the members after a specified period 

Pay part or whole of the deposit and ( reward)to the members 

DISPUTE RESOLUTION

Any dispute, disagreement, and/ or grievance between any member and the company (Top Earners Market) shall in the first instance be referred for

a) Mediation. 

The mediators shall be persons drawn from either the Religious faiths such as Bishops,  Reverends, Priests, and Imams or from the professional bodies of  Attorneys/Advocates or chartered accountants. Each party shall nominate  2 members for Mediation.

The mediation process shall be conducted vide Zoom or Skype as the Global community has embraced the use of such technology.

In the event the mediation process fails, to resolve the dispute/ disagreement and/ or grievance, the same shall be referred for Arbitration.

b) Arbitration 

Disputes arising from a  failed mediation process shall be referred to Arbitration. International Arbitration standards shall be observed.

The parties shall consent and/ or agree on who to Arbitrate the dispute.

The parties are allowed to be represented by Attorneys/Advocates/lawyers of their choice.

In the event the  Arbitration process fails to resolve the dispute, the same shall be referred to Court (Litigation process)

c) Litigation 

Since Top Earners Market is registered in Seychelles, the power or legal authority (Jurisdiction) to try cases and determine legal matters is vested in the courts of Seychelles.

Disputes not resolved by the Arbitration process shall be referred to the courts of Seychelles.

The parties shall be permitted to be represented by Attorneys / Advocates of their choice.

The court hearing sessions can be conducted vide Zoom or Skype as the world has embraced modern Technology in judicial  matters 

ADMISSION TO MEMBERSHIP

It is a policy of Top Earners Market and also a matter of self-regulation that before any member can open an account, Top Earners Market must conduct due diligence on all prospective members on our website/ platform in line with know your customer details (KYC).

New applicants who seek to join Top Earners Market and also all current members of Top Earners Market shall only be allowed to open one account per person and shall only use one (1) type of identification document for all the staking plans. (E.g If a member elects to use his identity card as his identification document when opening an account, then he/she must thereafter only use his identity card for all the staking plans.
